Overview

During discharge at Tin-Can Island Port, Lagos, sea water entered a vessel's cargo hold and damaged more than 2,077 metric tons of malted barley imported from Germany.

Our approach

We attended the discharge, established the cause and extent of the damage, and worked through the shipping documents to determine liability.

Findings

The claim was complicated by fire incidents during discharge and by subrogation issues with the shipping company.

Outcome

We provided a fair settlement recommendation while preserving insurers' rights of recovery against the carrier.

Key takeaway

Early attendance at discharge and careful handling of carrier liability protect both the settlement and the insurer's subrogation position.
